March 25, 2025 Opinion or Order Filing 7 ORDER granting in part #6 Motion to Compel Service of Process and to Issue Order to Show Cause Under 28 U.S.C. 2243. The Court notes that Petitioner claims judicial inaction. However, he waited an entire month to inform the Court that the Respondent was refusing to accept service. The Petition has not been served, and Petitioner has not identified any circumstances warranting a speedier adjudication than other habeas cases. Consequently, the Clerk of the Court shall serve a copy of the Petition for Writ of Habeas Corpus Under 28 U.S.C. 2241 (Docket No. 1) and this ORDER, by certified mail, to Respondent Frances Rivera, Warden of MDC Guaynabo ("Warden") and to the United States Attorney General by March 31, 2025. See Rule 4 of the Rules Governing Section 2254, 28 U.S.C. foll. 2254, which are applicable to petitions filed under 2241; see e.g., Hines v. Johnson, No. 1:19-CV-284-P, 2019 WL 13447128, at *1 (W.D. La. Apr. 18, 2019). The Warden shall file an answer, motion or other response to the allegations of the petition and the preliminary injunction (Docket No. 2) by April 8, 2025.
