Summer Infants Motion for Summary Judgment (ECF No. 99 ) is GRANTED. Judgment on Summer Infants complaint and TOMYs counterclaim is entered in favor of Summer Infant and against TOMY; the Accused Tub does not infringe the 209 Patent.
