I find all allegations against Defendants Delivery Company Cambridge, Massachusetts and Robyn Fontaine should be dismissed for failure to state a claim under Rule 12(b)(6). Nevertheless, because Plaintiff may be able to cure some of the deficiencies identified in this report and recommendation, I alsorecommend that Plaintiff be allowed to file an amended complaint within thirty days of the Courts adoption of this report and recommendation. TEXT ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Plaintiffs motion to proceed in forma pauperis (ECF No. 2) is provisionally granted based on the satisfaction of the 28 U.S.C. section 1915(a)(2) factors. However, because it is unclear what persons or entities are to be served, the Clerk should not initiate the process of issuing summonses to serve the complaint until either an amended complaint that states a plausible claim against all three defendants is filed or until thirty days passes from the adoption of the accompanying report and recommendation without amendment.
