TEXT ORDER adopting #10 Report and Recommendations ("R. & R.") over #11 Plaintiff's Objection to the Report and Recommendation. After careful consideration, the Court adopts the conclusions and reasoning of the Report and Recommendation, except as to the determination that Plaintiff had "three strikes" under 28 U.S.C. 1915(g) prior to the filing of this suit. See R. & R. 6-9. While the thoughtful analysis of the Magistrate Judge may well be correct, the Court declines to reach a question that it need not decide in the presence of an active circuit split. See id. at 8. This determination will have no effect on future litigation efforts by Mr. Diaz, because whether or not he was a "three-striker" prior to the filing of this suit, there is no question he is one now. Therefore, for the reasons stated in the R. & R., Plaintiff's Complaint, ECF No. #1 , is DISMISSED as frivolous and for failure to state any legally viable claims; his application to proceed in Forma Pauperis, ECF No. 4, is [DENIED] as moot; his Motion to Amend, ECF No. #8 , is DENIED because it is unrelated to the claims of his original complaint; and his Motion for a Temporary Restraining Order and Injunctive Relief, ECF No. #9 , is DENIED as moot.
