TEXT ORDER adopting the conclusions of Magistrate Judge Almond's #3 Report and Recommendation ("R. & R.") over Plaintiff's #4 Objection. Although Plaintiff correctly points out that the R. & R. contains a factual errornoting that Plaintiff receives $100 per month from a relative when he in fact gives $100 per month to a relative--upon review the Court concludes that the error does not change the ultimate result. The Court agrees with Judge Almond that, based upon Plaintiff's work history and current employment, his savings, his asset, and his monthly expenses, Plaintiff has sufficient assets to pay the fees and costs of this case. Thus, Plaintiff's #2 Motion to Proceed in forma Pauperis is DENIED, and Plaintiff is ordered to pay the filling fee within 30 days. Failure to do so will result in dismissal. So Ordered by District Judge William E. Smith on 10/19/2022. (Urizandi, Nissheneyra) |
