TEXT ORDER - The prior Text Order denying without prejudice Plaintiff's Motion for Limited Expedited Discovery (ECF No. 7) is hereby VACATED and the Motion is GRANTED in limited part as follows. After hearing, the Court concludes that Plaintiff has shown good cause for limited expedited discovery based upon (1) the allegations in its Complaint (including the timing of Defendant's resignation, the post-employment restrictive covenants in her Employment Agreement with Plaintiff, and the post-resignation emails from a current customer to Plaintiff indicating that it was transferring its business to another provider and intended to continue to work with Defendant as its broker and was interested in a smooth transition) and (2) Plaintiff's representation that it intends to promptly file a motion for preliminary injunction which will likely require a contested evidentiary hearing. Plaintiff may move forward and serve its proposed early discovery requests at this time but its request for a ten day response deadline is rejected as unreasonable given the scope of the requests. Defendant and the non-party recipients of such discovery requests shall respond to the requests in accordance with the applicable Rules within twenty-one days of the date of service. #7 Motion for Discovery. TEXT ORDER - In light of the recent appearance of counsel for Defendant Terry, counsel are directed to promptly meet and confer in good faith regarding Plaintiff's request for limited expedited discovery. Today's Zoom discovery conference is cancelled and continued to next Tuesday, June 20, 2023 at 11:00 am to allow counsel the reasonable opportunity to reach agreement on the issue. If agreement is reached, counsel shall inform the Court and the Tuesday conference will be cancelled.
