June 3, 2024 Opinion or Order TEXT ORDER granting #2 Motion for Leave to Proceed in forma pauperis. ; finding as moot #5 Motion for Leave to Proceed in forma pauperis. The plaintiff's Motion for Leave to Proceed In Forma Pauperis (ECF No. 2) is GRANTED. He still must, however, pay the statutory filing fee of $350.00 for this action. He must pay, when funds exist, an initial filing fee of 20% of the average monthly deposits to, or the average monthly balance in, his inmate account, whichever is greater, as determined by the six months preceding the filing of the complaint. Subsequently, he must pay monthly 20% of the previous month's income credited to his account. 28 U.S.C. 1915(b)(1) and (2). As determined by the account statement filed, the average monthly balance has been $174.62 and the average monthly deposit $231. Therefore, Mr. Callahan is required to make an initial payment of $46.21 to the extent that funds are available in his account in excess of $10.00, and the ACI is directed to forward to the Court each month 20% of the previous month's balance in his account each time that amount exceeds $10.00 until the entire filing fee of $350.00 is paid.
