TEXT ORDER granting Plaintiff's #2 Motion for Leave to Proceed In Forma Pauperis. The Clerk's Office is directed to procure summonses so that Plaintiff's #1 Complaint may be served. Plaintiff must pay as an initial filing fee the greater of twenty percent (20%) of the average monthly deposits to his account or the average monthly balance for the six months prior to the filing of his Complaint. See 28 U.S.C. 1915(b)(1). Subsequently, he must pay monthly twenty percent (20%) of the previous month's balance in his account. See id. 1915(b)(2). Plaintiff's account during the applicable period had an average monthly balance of $231.15 and average monthly deposits of $70. Accordingly, Plaintiff is required to pay as an initial filing fee $46.23 ($231.15 x 20% = $46.23). See id. Defendant Rhode Island Department of Corrections is directed to forward to the Court each month 20% of the previous month's balance in Plaintiff's account each time that amount exceeds $10.00 until Plaintiff has paid the entire filing fee of $350.00.
