November 14, 2024 Opinion or Order TEXT ORDER reserving on Plaintiff Deric Thompson's #2 Motion for Leave to Proceed In forma pauperis. Thompsons #1 Complaint does not contain a "short and plain statement of the claim[s] showing that [he] is entitled to relief." Fed. R. Civ. P. 8(a)(2). Instead, the Complaint features a wandering recitation of various legal authorities and makes vague claims regarding his interest in a disputed property. See generally Compl. Although the Court has liberally construed Thompson's allegations and legal claims because he is a pro se litigant, his Complaint nevertheless falls short of the standard set forth in Rule 8(a)(2). See Haines v. Kerner, 404 U.S. 519, 520-21 (1972) (per curiam) (noting that allegations in a pro se complaint are held "to less stringent standards than formal pleadings drafted by lawyers"). Rather than dismissing the Complaint for failing to state a claim, the Court affords Thompson thirty (30) days to file an amended complaint under Federal Rule of Civil Procedure 15. Failure to file an amended complaint by that deadline December 12, 2024 will result in dismissal under 28 U.S.C. 1915(e)(2)(B)(ii). Additionally, the Proof of Service, ECF No. 4, is stricken from the record because the Clerk has not yet issued Summons. The Court stays proceedings on all other pending motions (ECF Nos. 7, 9-11)..
