Filing 14 ***DOCUMENT MAILED 13 Text Order on Report and Recommendation, Order on Motion to Expedite placed in U.S. Mail from Columbia Clerks Office to Raymond Edward Chestnut, 324086, Dillon County Detention Center, 1027 Old Latta Hwy., Dillon, SC 29536. (lbak) |
Filing 13 TEXT ORDER: In July 2022, Petitioner filed a 28 U.S.C. 2241 petition asserting the Federal Bureau of Prisons had failed to consider him for a halfway house or home confinement for the last 10% of his supervised release sentence. ECF No. #1 . The Magistrate Judge entered a Report and Recommendation (R & R) recommending dismissal of the petition, and Petitioner filed objections to the R & R and a motion to expedite. ECF Nos. #7 , #9 & #10 . However, on September 12, 2022, Petitioner was released from federal custody with no supervised release to follow. Accordingly, his 2241 petition is MOOT. See, e.g., Porter v. Wilson, 757 F. App'x 281 (4th Cir. 2019) (finding a 2241 appeal moot because the petitioner "ha[d] been released from custody, and his supervised release was terminated"). Petitioner's motion to expedite is also MOOT. Signed by Chief Judge R. Bryan Harwell on 9/14/2022.(eney, ) |
