ORDER adopting 72 Report and Recommendations; granting in part and denying in part 39 Motion for Summary Judgment; Specifically, the LCDC is not a proper § 1983 defendant and is therefore dismissed, and the Plaintiffs failure to protect claim is dismissed with prejudice. The Defendants are denied summary judgment as to the Plaintiffs denial of medical treatment claim against all Defendants and his supervisory liability claim against Defendant Sheriff Ricky Chastai n, and these claims will proceed. As the Defendants Motion for Summary Judgment has been denied in part, the case shouldproceed to trial. Ms. Anna Hamilton, Esquire, of Nelson Mullins law firmis APPOINTED as counsel to assist the Plaintiff in the ins tant case. The Clerk of Courts Office is directed to produce any and all documents on file with their office to Ms. Hamilton. Counsel for the Defendants and appointed counsel for the Plaintiff are instructed to confer regarding submitting a joint consent scheduling order to the Court.
