November 28, 2018 Opinion or Order Filing 65 ORDER AND OPINION The Court GRANTS IN PART AND DENIES IN PART Defendant Bullard Company's Motion for Summary Judgment (Dkt. No. 49 ) and GRANTS IN PART AND DENIES IN PART Plaintiff SafeRack LLC's Motion for Summary Judgment (Dkt. No. 50 ). Defendant Bullard's Motion for Summary Judgment is GRANTED as to SafeRack's claim for unjust enrichment. Defendant Bullard's Motion for Summary Judgment is otherwise DENIED. Plaintiff SafeRack's Motion fo r Summary Judgment is DENIED as to its request for actual damages and DENIED AS MOOT as to its claims for trade dress infringement and unfair competition under § 1125(a) of the Lanham Act. Plaintiff SafeRack's Motion for Summary Judgment is otherwise GRANTED. Further, the Court hereby issues the following permanent injunction and ENJOINS Defendant Bullard Company, its officers, agents, servants and employees from competing unfairly with SafeRack and from using SafeRack's trademark s in any manner whatsoever that is likely to cause confusion including, but not limited to, using the color orange as applied to the railings, gates and cages of fall protection equipment. The Court DENIES AS MOOT SafeRack LLC's motion to strike references to Jill Morton's testimony in Bullard Company's motion for summary judgment. (Dkt. No. 53 .) AND IT IS SO ORDERED.
