Filing 8 TEXT ORDER: Plaintiff Mother Doe filed this case as "Mother Doe, individually and as the mother and natural guardian for Jane Doe, a minor." Plaintiff notes in Paragraph 3 of her Complaint she and her daughter are "using pseudonyms due to the sensitive nature of the subject matter of this action and due to the age of Jane Doe at the time of the allegations contained herein." ECF No. #1 . While the court finds this sufficient for the minor Jane Doe (see Fed. R. Civ. P. 5.2(a)(3)), it is insufficient for Mother Doe under Fed. R. Civ. P. 10(a), unless Mother Doe seeks and receives permission from the court to proceed anonymously. See James v. Jacobson, 6 F.3d 233, 238 (4th Cir. 1993). By October 24, 2018, Plaintiff Mother Doe shall either file an amended complaint in her true name or a motion to proceed anonymously. "A plaintiff seeking to proceed anonymously must show that [she] has a substantial privacy right that outweighs the customary and constitutionally-embedded presumption of openness in judicial proceedings." Richard S. v. Sebelius, C/A No. 3;12-cv-00007-TMC, 2012 WL 1909344, at *1 (D.S.C. May 25, 2012). (Amended Complaint/Motion due by 10/24/2018) Signed by Honorable Cameron McGowan Currie on 10/10/2018.
