Filing 49 ORDER adopting in part Report and Recommendations; granting 37 Motion for Summary Judgment. The part of the Report regarding the § 1983 claim is adopted and incorporated by reference, and that claim is dismissed with pre judice. The court declines to adopt the Reports recommendation of remandfor the state law claims, and finds the negligence and IIED/outrage claims are untimely and should be dismissed with prejudice. Plaintiffs claim against Defendant Town of Kingstr ee for false imprisonment under the SCTCA is also dismissed with prejudice for reasons set forth above. Plaintiffs state law claim for malicious prosecution is dismissed as agreed by Plaintiff,and all claims against Defendants Shaw and Kingstree Police Department are dismissed with prejudice.
