Filing 28 OPINION AND ORDER: The court adopts the Magistrate Judge's 17 Report and Recommendation. It is therefore ORDERED that Brown's § 2254 petition, docket number 1 , is dismissed with prejudice. It is further ORDERED that a certificate of appealability is denied because Brown has failed to make "a substantial showing of the denial of a constitutional right." 28 U.S.C. § 2253(c)(2).
