March 8, 2024 Opinion or Order Filing 7 ORDER denying plaintiff's #5 Motion to Appoint Counsel. Parties in a civil Social Security appeal do not have a constitutional or statutory right to court-appointed counsel. Ward v. Smith, 721 F.3d 940, 942 (8th Cir. 2013); Russell v. Chater, 62 F.3d 1421 (8th Cir. 1995). The court finds no justification for plaintiff's request for the following reasons. In a social security appeal, there is no discovery to be done nor any examination of witnesses in a courtroom. The court's review is limited to a review of the settled administrative record--which will be provided by the Commisioner-- and application of the law to the issues of review raised by plaintiff. Furthermore, plaintiff is pro se, but not incarcerated. She has the ability to research matters herself or to freely contact lawyers who do social security disability work to see if they will take her case. Signed by US Magistrate Judge Veronica L.
