JUDGMENT ORDER, Defendants' motion for summary judgment 34 is GRANTED, and this pro se prisoners civil rights action, filed under 42 U.S.C. § 1983, is DISMISSED WITH PREJUDICE. All other pending motions are DENIED as m oot. Because the Court CERTIFIED in the memorandum opinion that any appeal from this order would not be taken in good faith, should Plaintiff file a notice of appeal, he is DENIED leave to appeal in forma pauperis. MEMORANDUM OPINION AND ORDER. The Court is in receipt of a pro se prisoners complaint under 42 U.S.C. § 1983 2 and a motion for leave to proceed in forma pauperis 1 . It appears from the motion for leave to proceed in forma pauperis [Doc. 1] that Plaintiff lacks sufficient financial resources to pay the filing fee. Accordingly, pursuant to 28 U.S.C. § 1915, this motion 1 will be GRANTED. Because Plaintiff is an inmate in the McMinn County Justice Center, he wil l beASSESSED the civil filing fee of $350.00.
