October 10, 2019 Opinion or Order Filing 13 ORDER: Pending before the Court is Plaintiff's motion to amend (Docket No. 11), which, the Court notes, is unnecessary as Plaintiff is permitted to amend his complaint as matter of course under Fed. R. Civ. P. 15(a)(1)(B), but is nevertheless GRANTED. The Clerk is directed to separately file the First Amended Complaint (found at Docket No. 11-1). Once filed, the First Amended Complaint is the legally operative complaint, Drake v. City of Detroit, 266 F.App'x 444, 448 (6th Cir. 2008), thus rendering moot Defendant's pending motion to dismiss (Docket No. 6). The Clerk is therefore directed to terminate that motion. Defendant shall answer or otherwise respond to the First Amended Complaint in accordance with Fed. R. Civ. P. 15 (a)(3). Also pending is Defendant's motion to consolidate cases (Docket No. 9). Although no timely response to the motion to consolidate was filed (see Local Rule 7.01(a)(3)), which indicates the motion is unopposed (id.), the motion is DENIED WITHOUT PREJUDICE for the following reasons.
