ORDER: For the reasons set forth in the accompanying Memorandum, the Court hereby enters the following rulings: (1) Defendants' Motion for Summary Judgment 17 is GRANTED with respect to Plaintiffs' federal claims, and Plaintiffs' Fou rth and Fourteenth Amendment claims under the United States Constitution are hereby DISMISSED WITH PREJUDICE; (2) Plaintiffs' state law claims are REMANDED to the Smith County Circuit Court; and (3) In accordance with these rulings, the Clerk is directed to enter a Judgment in a separate document pursuant to Federal Rule of Civil Procedure 58. ORDER: The defendants filed a motion for summary judgment with supporting documents on 5/20/2011, 17 . In accordance with the Initial Case Management Order entered 8/25/2010, the Final Pretrial Conference is set before District Judge Haynes in Cooke ville on 10/7/2011 and a Jury Trial is set in Cookeville on 10/25/2011. Inasmuch as there appear to be no further proceedings to be conducted before the Magistrate Judge, the Clerk is directed to term the referral and transmit this file to the District Judge.
