AGREED ORDER OF PARTIAL DISMISSAL AND RESPONSE TO COMPLAINT: Thus, the Parties agree that Plaintiffs' direct negligence claims against Swift for negligence in its hiring, training and/or supervision of defendant Ramirez, its maintenance of the tractor or its entrustment of the tractor to defendant Ramirez (set forth in paragraphs 14, 15, 16 and 18 of the Complaint) are barred based on the preemption rule. The Parties further agree that Swift may have until October 15, 2021 to file its response to Plaintiffs' Complaint. Therefore, Plaintiffs' direct negligence claims against Swift, asserted in paragraphs 14, 15, 16 and 18 of the Complaint, are hereby dismissed, with prejudice. Signed by Chief Judge Waverly D.
