Filing 65 ORDER: For the reasons stated below, the Pesaks' Motion 51 is DENIED. Vanderbilt's Motion 52 is GRANTED in part as to the Pesaks' counterclaims for abuse of process, intentional infliction of emotional distress, fraud, unjust emich ment and violations of the Tennessee Consumer Protection Act, and DENIED in part as to Vanderbilt's restitution claim.
