P. 72(b)(3) and Local Rule 72.03(b)(3), the Court has reviewed de novo the Report and Recommendation, the Objections, and the file. The Objections of the Plaintiff are overruled, and the Report and Recommendation is adopted and approved. A ccordingly, Defendants' Motions to Dismiss or for Summary Judgment (Docket Nos. 134 , 138 and 141 ) are GRANTED, and this action is DISMISSED. Any other pending Motions are DENIED as moot, and the Clerk is directed to close the file. The jur y trial set for November 15, 2011, and the pretrial conference set for November 4, 2011, are canceled. This Order shall constitute the final judgment in this case pursuant to Fed. R. Civ. January 3, 2011 Opinion or Order Filing 93 ORDER ADOPTING REPORT AND RECOMMENDATIONS: Presently pending is a Report and Recommendation 49 from the Magistrate Judge urging the Court to deny the plaintiff's Requests. The plaintiff has filed no objections to the Report and Recommendation. The Court has conducted a de novo review of the Report and Recommendation along with the record and finds that the Magistrate Judge's conclusion is well reasoned.
