ORDER: The Report and Recommendation is therefore ACCEPTED and made the findings of fact and conclusions of law of this court. For the reasons expressed therein, it is hereby ORDERED that the Motions to Dismiss filed by the defendants (Docket Nos. 36 , 44 ) are GRANTED. REPORT AND RECOMMENDATION: For the reasons stated below, the undersigned RECOMMENDS that the defendants' motions to dismiss the federal claims against them (Docket Entry No. 36 , 44 ) be GRANTED, that the plaintiff's federal claims be DI SMISSED WITH PREJUDICE, and that the plaintiff's state law claims filed in federal court pursuant to 28 U.S.C. § 1367 be DISMISSED WITHOUT PREJUDICE in order that the plaintiff may bring his claims in the appropriate state court.
