REPORT AND RECOMMENDATION: For the reasons stated below, the undersigned RECOMMENDS that the defendants' motions to dismiss the federal claims against them (Docket Entry No. 36 , 44 ) be GRANTED, that the plaintiff's federal claims be DI SMISSED WITH PREJUDICE, and that the plaintiff's state law claims filed in federal court pursuant to 28 U.S.C. § 1367 be DISMISSED WITHOUT PREJUDICE in order that the plaintiff may bring his claims in the appropriate state court.
