ORDER: Pending before the Court is a Motion Under 28 U.S.C. 2255 to Vacate, Set Aside or Correct Sentence (Doc. No. #1 ), filed by Movant/Petitioner, pro se. Having conducted a preliminary review of the Motion without determining the ultimate merits of Movant/Petitioner's claim(s), the Court concludes that Movant/Petitioner has satisfied the initial threshold requirement set forth in Rule 4(b) of the Rules Governing Section 2255 Proceedings for the United States District Courts ("Section 2255 Rules"). Accordingly, Respondent shall file an answer, plead, or otherwise respond to the Motion in conformance with Rule 5 of the Section 2255 Rules within sixty (60) days of the date of entry of this Order on the docket. By that same date, Respondent shall also file a response to Petitioner's Motion to Produce Documents (Doc. No. #2 ).
