ORDER: WHEREAS, Adam Franchi (Plaintiff) initially filed this action on October 29, 2019; WHEREAS, all Defendants named in the October 29, 2019, Complaint (ECF No. 1), hereby agree to accept service of the Complaint without waiver of any of their rights and defenses (except as to sufficiency of service); WHEREAS, on January 27, 2020, the Court issued an Order consolidating three related actions and appointing SEIU Health Care Employees Pension Fund as Lead Plaintiff (ECF No. 68); and WHEREAS, Lead Plaintiff and Defendants (collectively, the Parties) have met and conferred and hereby propose the following schedule for the filing of a consolidated complaint and the response thereto; NOW, THEREFORE, the Parties, through their undersigned attorneys and subject to the Court's approval, stipulate and agree to the following: By February 21, 2020, Lead Plaintiff will file a Consolidated Complaint; Defendants' response to the Consolidated Complaint will be due 30 days after Lead Plaintiff files its Consolidated Complaint; If Defendants move to dismiss the Consolidated Complaint, Lead Plaintiff's opposition to Defendants' motion to dismiss will be due 30 days after Defendants file their motion(s) to dismiss; and 4. If Defendants move to dismiss, Defendants' reply to Lead Plaintiff's opposition will be due 15 days after Lead Plaintiff files its opposition. Stipulated and agreed this 10th day of February, 2020.
