Filing 7 ORDER: To date, Plaintiff has not submitted the civil filing fee. However, Plaintiff has submitted an amended complaint (Doc. No. #5 ) and a "Notice." (Doc. No. #6 ). Although Plaintiff evidences his intent to prosecute this action by submitting these additional filings, he must pay the required filing fee in order to proceed. Considering Plaintiff's pro se status, the Court construes his "Notice" as a motion to extend the time within which to pay the civil filing fee, which the Court GRANTS. Plaintiff must pay the $400 filing fee no later than June 15, 2020. If he fails to do so, this case will be dismissed. Signed by District Judge Eli J. Richardson on 6/1/2020. Filing 4 ORDER: Demetrice Gerald King filed a pro se complaint against Murfreesboro, Tennessee (Rutherford County) and Rutherford County City Government pursuant to 42 U.S.C. 1983. (Doc. No. #1 ). King also filed an application for leave to proceed in forma pauperis. (Doc. No. #2 ). Based upon Plaintiff's reported household income and listed expenses, the Court finds that Plaintiff is not so indigent that he cannot pay court costs without undue hardship. Accordingly, the Court concludes that Plaintiff is not eligible to proceed in forma pauperis. The Court therefore DENIES the application to proceed in forma pauperis. (Doc. No. #2 ). Accordingly, Plaintiff is ORDERED pay the filing fee of $400 with 30 days of receiving this Order to proceed with this action. Signed by District Judge Eli J. Richardson on 4/21/2020.
