Filing 5 ORDER: Accordingly, the Clerk of Court MUST amend the docket in this case to reflect Warden Boyd as sole Respondent. Petitioner's IFP submission (Doc. No. 2) is out of the ordinary. It establishes that, although Petitioner had 13 cents in his trust account the day his account statement was printed, he regularly has a balance of $25-50 and, more importantly, he has submitted a withdrawal request for payment of the $5 filing fee to this Court. (Doc. No. 2 at 78.) A note on the application asks the Court to please hold my petition until I am provided with my (6) month Trust Fund balance [sic] to pay filing fee. (Id. at 7.) Accordingly, the court understands Petitioner's IFP application to be simply a placeholder and an attempt to extend Petitioner's time to pay the filing fee. The Court therefore GRANTS Petitioner 28 days from entry of this Order within which to pay his filing fee. If Petitioner requires additional time beyond the 28 days due to no fault of his own, he may file a motion for additional extension of time. To the extent Petitioner technically asks to proceed without payment, that request (Doc. No. 2) is DENIED as moot in light of Petitioner's apparent ability and intention to pay the fee. Signed by District Judge William L. Campbell, Jr on 4/17/2020. (xc:Pro se party by regular mail. ) (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(am) Modified Text on 4/17/2020 (am). |
