ORDER DISMISSING CASE: Plaintiff's application to proceed as a pauper (Doc. No. #2 ) is DENIED. Plaintiff's application reflects that he does not have any available financial resources (see id.), so it would be futile to grant Plaintiff additional time to pay the full $402 filing fee. This action is therefore DISMISSED without prejudice to Plaintiff's ability to file a motion to alter or amend judgment accompanied by the $402 filing fee within 28 days of entry of this Order.
