MEMORANDUM OPINION AND ORDER: For the reasons stated herein, Defendant's motion to dismiss at Doc. No. #16 is GRANTED in part and DENIED in part. Specifically, Defendant's Motion is denied insofar as it requests dismissal based on lack of standing. The Motion is GRANTED insofar as it requests dismissal for failure to state a claim upon which relief can be granted. This is the final order in the case.
