Filing 8 ORDER: Jonathon Leonard, a state prisoner at the DeBerry Special Needs Facility in Nashville, Tennessee, filed a pro se Petition for a writ of habeas corpus under 28 U.S.C. 2254 (Doc. No. #1 )and paid the filing fee (Doc. No. #7 ). Because Petitioner paid the full filing fee, his previously-filed application to proceed in forma pauperis (Doc. No. #5 ) is DENIED AS MOOT. Accordingly, Respondent is DIRECTED to file an answer, plead or otherwise respond to the Petition in accordance with Habeas Rule 5 within 30 DAYS of the date this Order is entered on the docket. Finally, Petitioner moves for the appointment of counsel because he "is unable to pay the costs of an attorney." (Doc. No. #2 ). This motion is DENIED WITHOUT PREJUDICE. Because this is a civil case, the appointment of counsel "is not a constitutional right." The Clerk is DIRECTED to serve a copy of the Petition and this Order on Respondent and the Attorney General of Tennessee. See Habeas Rule 4. Signed by District Judge William L. Filing 4 ORDER: Jonathon Leonard, a state prisoner at the DeBerry Special Needs Facility in Nashville, Tennessee, filed a pro se petition for a writ of habeas corpus under 28 U.S.C. 2254. However, Petitioner has not paid the filing fee or applied to proceed as a pauper. To proceed, Petitioner MUST, within 30 DAYS of the date this Order is entered on the docket, either: (1) pay the $5.00 filing fee to the Clerk of Court, or (2) apply for in forma pauperis status by submitting both (a) an affidavit stating all assets he possesses and that he is unable to pay the filing fee, and (b) a certificate from the warden or other prison official showing the amount of money that the petitioner has in his inmate trust account.
