ORDER: Anthony Tucker, an inmate of the Lois M. DeBerry Special Needs Facility in Nashville, Tennessee, filed a pro se complaint pursuant to 42 U.S.C. 1983, alleging violations of his civil rights. (Doc. No. #1 ). He also filed an Application for Leave to Proceed In Forma Pauperis ("IFP Application") (Doc. No. #2 ); a Motion to Produce Documents (Doc. No. #3 ); and a Motion for Preliminary Injunction and Temporary Restraining Order (Doc. No. #6 ). To file a federal civil lawsuit, a plaintiff must submit the civil filing fee or an IFP Application. Plaintiff has submitted an IFP Application and a copy of an Order issued by the United States Court of Appeals for the Sixth Circuit in which the Court refers to Plaintiff as indigent. (Doc. No. #2 ). Regardless of the Sixth Circuit's finding of Plaintiff's indigency in a different case earlier this year, by statute Plaintiff must submit a certified copy of his inmate trust fund account statement in this case. The Court acknowledges that Plaintiff has a motion seeking expedited relief in this matter. (See Doc. No. #6 ). However, the Court cannot address that motion until the matter of the filing fee has been resolved. Plaintiff's Motion to Produce Documents will be HELD IN ABEYANCE pending the resolution of the filing fee. Signed by District Judge Waverly D. Crenshaw, Jr on 11/4/2024.
