MEMORANDUM OPINION AND ORDER - GRANTING 33 MOTION for Summary Judgment (Partial) filed by State Farm Lloyds. It is further ORDERED that Plaintiff take nothing by her extra-contractual claims of breach of the duty of good faith and fai r dealing, violations of the Texas Insurance Code,violations of the Texas Deceptive Trade Practices Act and tie-in statutes, unfair insurance practices, and misrepresentation, and that those claims should be DISMISSED with prejudice. Only Plaintiffs breach of contract claim, alleging that Defendant failed to pay her the benefits under the Policy to properly repair her Property, should proceed to trial. Signed by Judge Amos L.
