MEMORANDUM ADOPTING REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE, re [ 57 Report and Recommendation, 22 MOTION for Sanctions, Motion to Declare Mr. Johnson a Vexatious Litigant filed by Target Corporation, 23 MOTION to Dismiss filed by Target Corporation, 37 MOTION to Dismiss Rule 8 Motion to Dismiss filed by Target Corporation, 39 MOTION for Summary Judgment filed by Target Corporation, 40 MOTION to Dismiss, Rule 8 Motion to Dismiss filed by Target Corporation. Having received the report of the United States Magistrate Judge, having considered each of Plaintiff's timely filed objections (Dkt. #59), and having conducted a de novo rev iew, this Court is of the opinion that the findings and conclusions of the Magistrate Judge are correct and adopts the Magistrate Judge's report (Dkt. #57) as the findings and conclusions of the Court. Plaintiff's claims against Defe ndant Target Corporation are DISMISSED with prejudice. It is, therefore, ORDERED that Defendant's Motion to Dismiss (Dkt. #23) is GRANTED. It is further ORDERED that Defendant's Motion to Dismiss for Failing to State a Claim (Dkt. #3 7), Motion for Summary Judgment (Dkt. #39), and Rule 8 Motion to Dismiss (Dkt. #40) are DENIED AS MOOT. It is further ORDERED that Defendant's Motion to Declare Mr. Johnson a Vexatious Litigant (Dkt. #22) is DENIED. All relief not previously granted is hereby denied.
