MEMORANDUM OPINION AND ORDER - It is therefore ORDERED that Natural Polymer International Corporation's Motion for Summary Judgment (Dkt. 19 ) is hereby GRANTED. The Court finds FedEx failed to properly limit its liability under the Carmack Amendment. As a result, FedEx is liable for the full amount of damages. It is further ORDERED that FedEx Freight, Inc.'s Motion for Summary Judgment (Dkt. 20 ) is hereby DENIED. It is further ORDERED that Plaintiff Natural Polymer International Corporation file a proposed final judgment within five (5) days of this order. Signed by Judge Amos L. Mazzant, III on 8/17/2017.
