MEMORANDUM ORDER ADOPTING THE MAGISTRATE JUDGE'S REPORT AND RECOMMENDATION for 7 Report and Recommendations. ORDERED that Movant Julio Cesar Maldonado-Gonzalez's Motion to Vacate, Set Aside or Correct Sentence by a Person in Federal Custody (#1) pursuant to 28 U.S.C. § 2255 is GRANTED to the extent that the sentence imposed in Criminal Number 4:12CR00252-006 is VACATED, and Movant shall be resentenced. It is further ORDERED that the United States Probation Office shall p repare a new Presentence Investigation Report reflecting Movant's objection to the previous Presentence Investigation Report and the correct calculation.
