April 15, 2019 Opinion or Order Filing 2 ORDER: Plaintiffs are inmates at the John Middleton Unit of the Texas Department of Criminal Justice. They filed a civil rights complaint under 42 U.S.C. 1983 alleging that they were continuously exposed to raw sewage and methane gas in the dormitory and kitchen of the Middleton Unit. For the reasons stated herein, the Court finds that each Plaintiff should be required to file a separate complaint asserting his individual claims. It is ORDERED that Plaintiff shall, within twenty days from the date of this Order, pay the filing fee of $400.00 or file with the Clerk a signed Application to Proceed in Forma Pauperis and a copy of his inmate trust account statement and a signed copy of the AUTHORIZATION portion of the Certificate of Inmate Trust Account. (4) Each Plaintiff shall, within twenty (20) days of the date of this order, file an Amended Complaint setting forth their specific claims. Each Plaintiff shall use the form provided by the Court. Failure of any of the Plaintiffs to file the required documents will result in a denial of in forma pauperis status and a dismissal of that Plaintiffs complaint for want of prosecution without further notice, unless the filing fee of $400.00 is timely paid. The Clerk shall mail to each of the Plaintiffs a 42 U.S.C. 1983 complaint form marked, Amended Complaint, an Application to Proceed in Forma Pauperis, and a Certificate of Inmate Trust Account and Authorization, each marked with the cause number assigned to their respective new complaint for their use in complying with this Order. The Clerk shall mail a copy of this Order to each Plaintiff. See Order for further details and instructions.
