December 2, 2020 Opinion or Order Filing 7 NOTICE OF DEFICIENCY AND ORDER: The Court finds that Plaintiff should, within 20 days from the date of this order, pay the filing fee of $402.00 or file with the Clerk the following: (1) A signed form application to proceed in forma pauperis; (2) A certified copy of his inmate trust account statement (or institutional equivalent) for the 6-month period immediately preceding the filing of his complaint. Failure to file the required documents will result in the denial of in forma pauperis status and the dismissal of Plaintiff's complaint for want of prosecution without further notice, unless the filing fee of $402.00 is timely paid. The Clerk will mail the application to proceed in forma pauperis form to Plaintiff, but he must obtain his certificate of inmate trust account from unit officials. December 2, 2020 Opinion or Order Filing 6 ORDER : Plaintiff filed a civil-rights complaint and requested appointment of counsel 4 and a preliminary injunction 5 . As explained herein, the motions are denied. Plaintiff's request for appointment of counsel is denied without prejudice to Plaintiff's right to request appointment of counsel after the Court has completed screening of his case or should there be a material change of circumstances. Plaintiff has failed to meet the elements required to justify the issuance of a preliminary injunction or temporary restraining order. Moreover, his generalized request for injunctive relief with respect to his prison conditions is not permitted under the PLRA. For these reasons, Plaintiff's motion for injunctive relief is denied. But this order should not be interpreted to state an opinion on the merits of Plaintiff's underlying constitutional claims. Plaintiff's civil-rights action remains pending judicial screening under 28 U.S.C. 1915 and 1915A. (Ordered by Judge James Wesley Hendrix on 12/2/2020) (jak)
