P Rule 41(a)(1)(A), a plaintiff may dismiss a lawsuit by notice only if it is filed before service by the opposing party of an answer or a summary judgment motion, whichever first occurs. Fed.R.Civ.P. 41(a). No Defendant to this case answered the Complaint or filed a Motion for Summary Judgment. Additionally, Plaintiff represents to the Court that this dispute has been fully resolved.
