November 22, 2017 Opinion or Order Filing 195 MEMORANDUM OPINION AND ORDER: The Court DENIES Jackson's 180 motion for partial summary judgment on the plaintiffs' state-law claims against him, and the Court GRANTS the plaintiffs 177 motion for partial summary judgment except insofar as the motion applies to the defendants' copyright counterclaim. As to the defendants' copyright counterclaim, the Court DENIES the plaintiffs' motion for partial summary judgment on the merits of the defendants' copyright counte rclaim and GRANTS in part and DENIES in part the plaintiffs' motion insofar as the motion applies to the damages element of the copyright counterclaim. Based on the evidence the defendants presented, the defendants may seek statutory damages only for infringement that occurred on 12/5/2015. (Ordered by Judge Jane J. Boyle on 11/22/2017) (ran)
March 29, 2017 Opinion or Order Filing 167 MEMORANDUM OPINION AND ORDER: The Court GRANTS in part and DENIES in part Defendants' Expedited Motion for Leave to Amend Counterclaims (Doc. 142 ). Should Defendants choose to amend their pleadings to the extent permitted by the Court above, they must do so by 4/3/2017. Under Rule 15(a)(3), Plaintiffs will have 14 days to answer. The Court DENIES without prejudice all pending Motions for Summary Judgement (Docs. 146 & 149 ). The parties may re-file summary judgment motions after Plaintiffs have had the opportunity to respond to Defendants' amended counterclaims. August 8, 2016 Opinion or Order Filing 129 MEMORANDUM OPINION & ORDER: The Court GRANTS Plaintiffs' Motion for Leave to File an Amended Complaint (Doc. 112 ). Should they choose to amend their pleadings, Plaintiffs must do so by 8/16/2016. Pursuant to Rule 15(a)(3), Defendants will ha ve 14 days to respond. To allow the parties an opportunity to file dispositive motions in relation to their live pleadings, the Court DENIES without prejudice all pending motions for summary judgment (Docs. 121 & 123 ). The parties may re-file t heir motions after Defendants have had an opportunity to respond to Plaintiffs' amended complaint. The Court EXTENDS the deadline for dispositive motions until 9/30/2016. The Court VACATES the current trial date to be reset at a later time. All deadlines directly associated with trial, including the deadlines for pretrial disclosures, pretrial materials, the exchange of exhibits, and pretrial conference are also VACATED.
