Filing 22 ***ORIGINALLY FILED IN 3:14-CV-1860-L*** ORDER: The court grants Plaintiff's Motion for Leave to File First Amended Complaint (Doc. 57) and directs Plaintiff to file its First Amended Complaint by 1/20/2016. To ensure that the case proceeds in an orderly fashion, the court denies without prejudice the following motions: Plaintiff Radio Networks, LLC's Motion for Partial Summary Judgment (Doc. 62); Defendants' Motion for Summary Judgment (Doc. 65); and Plaintiff Radio Networks, LLC's Motion to Exclude the Testimony of C.D. Shamburger, Jr. (Doc. 68). The court also vacates the March 2016 trial setting, pretrial conference, and pretrial deadlines. Filing 18 ORDER: Before the court is Plaintiffs' Motion for Consolidation (Doc. 17), filed July 9, 2015. Plaintiffs request that the court consolidate this action with an action previously filed by Defendants against Plaintiffs, Civil Action No. 3:14-CV-1860-L, which is also pending before this court. Plaintiffs' certificate of conference indicates that Plaintiffs were unable to contact counsel for Defendants before filing the Motion for Consolidation. Given the contentious nature of this and the related action and the motion to dismiss filed by Defendants in this case in which they contend that Plaintiffs' claims are improper compulsory counterclaims that should have been brought in the earlier filed action, the court assumes that the Motion for Consolidation is opposed. Accordingly, unless Defendants notify the court by 7/17/2015, that they are unopposed to the consolidation of the two cases, the court will delay ruling on the Motion for Consolidation until after it rules on Defendants' Motion to Dismiss (Doc. 6).
