Filing 150 MEMORANDUM OPINION AND ORDER: The Court DENIES the 107 plaintiffs' motion for partial summary judgment, GRANTS Matrix's 116 motion for summary judgment, and DISMISSES WITH PREJUDICE all of the plaintiffs' claims against Matrix. Bec ause the Court's opinion does not depend on either party's expert witness testimony or any objected to evidence, the Court DISMISSES AS MOOT the parties 113 , 115 motions to exclude and the plaintiffs' 134 objections. And because t he Court's opinion moots Matrix's fourth and fifth counterclaims against the plaintiffs, the Court DISMISSES AS MOOT both counterclaims four and five and the plaintiffs' 124 motion to dismiss them. Filing 48 MEMORANDUM OPINION AND ORDER: The court determines that the 42 findings and conclusions of the magistrate judge with respect to Matrix's Motion to Dismiss for Improper Venue, or Alternatively Transfer are correct, and accepts them as those o f the court. The court denies "Defendant Matrix Trust Company's (1) Motion to Dismiss for Improper Venue, or Alternatively, to Transfer and (2) Motion to Dismiss for Failure to State a Claim" (Doc. 25 ). By separate order, the c ourt will require Plaintiffs and Matrix to submit a joint status report and, after receiving the parties' joint status report, it will enter a scheduling order that will govern the proceedings in this case.
