In its discretion under FRCP 6(b), the Court finds that Bank of America's filing of its Motion to Dismiss (Doc. 18) one-day late constitutes excusable neglect. Moreover, despite Plaintiff's response (Doc. 22), the Court finds that the arguments raised by Bank of America's Motion are substantially similar to the ones raised in Defendant Prudential's timely Motion to Dismiss (Doc. 13), thus considering the day-late Motion would not prejudice Plaintiff or waste this Court's resources. Therefore, the Court GRANTS Bank of America's request for a one-day extension and will consider its Motion (Doc. 18) as timely. However, in the interest of justice and within the Court's discretion under Local Rule 83.1, the Court ORDERS Plaintiff to file its Response to Bank of America's Motion on or before January 10, 2019, and Bank of America to file its Reply on or before January 24, 2019.
