September 17, 2019 Opinion or Order Filing 3 Order: The #2 motion to appoint counsel is denied without prejudice, and, treating Whitfield's motion as a successive 2255 motion, the court transfers the motion to the United States Court of Appeals for the Fifth Circuit to seek authorization to file a successive 2255 motion. The court further directs the clerk of court to open for statistical purposes a new 2255 case (nature of suit 510 directly assigned, per Special Order 3-250, to the undersigned) and then close it on the basis of this order.
