TRANSFER ORDER: For the reasons set forth in the attached written Order, in the interest of justice, the Clerk of Court is respectfully directed to transfer this case to the United States District Court for the Northern District of Texas. See § 1406(a). The Court offers no opinion on the merits of petitioners claims. That provision of Rule 83.1 of the Local Rules of the Eastern District of New York that requires a seven-day delay is waived. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962).The Clerk of Court is directed to mail a copy of this order to petitioner, and to close the file. Ordered by Judge Roslynn R.
