Selmon's negligence claim, to the extent he intends to raise one, is DISMISSED WITHOUT PREJUDICE. If he so chooses, Selmon may bring this claim in the appropriate state court. February 2, 2023 Opinion or Order Filing 7 ORDER: Before the Court is Plaintif's application to proceed in forma pauperis in this civil-rights action. See ECF No. #5 . After review, the Court GRANTS Plaintiff's application and ORDERS the following: Plaintiff will not be assessed an initial partial filing fee because he lacks the requisite funds in his inmate trust account to pay an initial fee. However, Plaintiff will be required to pay the full filing fee of $350.00. When adequate funds exist in Plaintiff's inmate trust account, the agency having custody of Plaintiff shall pay the $350.00 in monthly installments. The Court DIRECTS the clerk of Court to mail a copy of this order to the inmate accounting office or other office responsible for managing Plaintiffs payments to the Court.
