Filing 8 JUDGMENT: For the reasons stated in the Court's Order of even date, It is ORDERED, ADJUDGED, AND DECREED that Plaintiff's civil rights complaint is dismissed pursuant to the three-strikes provision of 28 U.S.C. 1915(g). (Ordered by Senior Judge Sam R. Cummings on 10/11/2022) (krr) |
Filing 7 ORDER: Plaintiff is not eligible to proceed without prepayment of costs. He has not paid the $402.00 filing fee; so this case must be dismissed. As a result, it is ORDERED that Plaintiff's civil-rights complaint is DISMISSED pursuant to the three-strikes provision of 28 U.S.C. 1915(g). Any other pending motions are also DENIED. Plaintiff is also WARNED that frivolous and malicious filings by prisoners consume inordinate amounts of scarce judicial resources and pose a burden on legitimate complaints. See Holloway v. Hornsby, 23 F.3d 944 (5th Cir. 1194). The Court cautions Plaintiff that if he continues to file frivolous complaints, motions, or other documents, sanctions will be imposed against him. Such sanctions may include monetary sanctions, the dismissal of a complaint with prejudice, or a complete bar to filing pleadings without leave of the Court. Judgment shall be entered accordingly.
