ELECTRONIC ORDER: Plaintiff filed a motion to withdraw his civil-rights complaint. Dkt. No. #6 . Federal Rule of Civil Procedure 41(a) permits a plaintiff to dismiss an action without a court order by filing a notice of dismissal before the opposing party serves an answer. The Court finds that Plaintiff 's motion serves as a self-executing notice of voluntary dismissal under Rule 41(a). This case is now closed, and any pending motions are terminated. Plaintiff is advised that if he refiles his complaint, he must submit his complaint on the court-approved form for prisoner civil-rights cases, and he must pay the $402.00 filing fee or file an application to proceed in forma pauperis with a certified statement of his inmate trust account. SHOW CAUSE ORDER: Plaintiff must respond to this order within 20 days and show cause why the Court should not dismiss this complaint, assess a strike, and impose additional sanctions as described above. Plaintiff's response must include a sworn affidavit or unsworn declaration made under penalty of perjury pursuant to 28 U.S.C. 1746. Plaintiff is reminded that false statements in his pleadings may result in sanctions against him, including dismissal with or without prejudice, and th at false statements in an affidavit or unsworn declaration made under penalty of perjury may result in prosecution for perjury. If Plaintiff fails to respond, the Court will dismiss the complaint with prejudice and assess the fee, strike, and other sa nctions set out in this order. Deadline to reply to the answer is Twenty (20) days. The Clerk is directed to mail this show cause order to Plaintiff at the address of his current TDCJ unit to ensure that he receives it.
