ORDER RECHARACTERIZING MOTION as to Miguel Angel Fernandez, Jr in case 6:18-cr-00051-H-BU. Defendant Miguel Angel Fernandez, Jr., a state prisoner proceeding pro se, filed a motion concerning the execution of his federal sentence. See Dkt. No. 37 of criminal case. Because the Court cannot discern whether or not Fernandez exhausted his administrative remedies, and because Fernandez is currently incarcerated outside the Northern District of Texas, Fernandez's request for concurrent designation of his state and federal sentences is dismissed without prejudice. The Clerk is directed to (1) open for statistical purposes a new habeas corpus action under 28 U.S.C. 2241, (2) file Dkt. No. 37 as the originating document in the new case, (3) docket a copy of this order in the new habeas action, and (4) close the civil action on the basis of this order.
