ORDER. For the reasons stated above, the Court finds that Liberty Mutual did not breach the Insurance Policy by denying coverage. The Court hereby grants 21 Liberty Mutual's Motion for Summary Judgment on Plaintiffs' breach of contract claim. Liberty Mutual has not moved for summary judgment on plaintiffs' claims for violations of Section 541 and Section 542 of the Texas Insurance Code, and those claims remain pending.
