| Minute Entry for proceedings held before Magistrate Judge Diana Song Quiroga. INITIAL PRETRIAL AND SCHEDULING CONFERENCE held on 2/13/2023. Plaintiff appeared via Zoom through counsel Desiree Marrufo, and Defendants appeared via Zoom through counsel Julian Dominguez. The Court held a scheduling conference. Counsel for Plaintiff will file an appearance following this conference. This is a tort claim arising out of an automobile collision with a foreign driver and trucking company. Treatment for Plaintiff is ongoing but wrapping up; there has been a prior knee surgery and there is a future surgical recommendation for a lumbar spine surgery. Defendants believe additional time for discovery is necessary. Plaintiffs counsel inquired about the use of TRCP 18.001 affidavits; the issue will be revisited later. Defendants counsel indicates that there may be partial dispositive motions filed in this case. Parties already completed initial disclosures and do not anticipate joinder, for which the deadline is February 27, 2023. The Court consulted with counsel on other proposed deadlines to meet the needs of the case. If the parties wish to move for an independent medical examination, they will do so by July 14, 2023, and attach a proposed order by that same date. Parties are ordered to complete all discovery by October 27, 2023, to complete ADR by October 13, 2023, and to file dispositive motions by November 17, 2023. There is a status conference at 9:15 a.m., November 28, 2023. The Court will issue a scheduling order with the aforementioned agreed-upon dates.
